Purchasing a Freehold or Residential Leasehold Property

Conveyancers fees and disbursements

Our fees cover all of the work required to complete the purchase of your new home, including dealing with your mainstream mortgage, dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (Stamp Duty) if the property is in England, or Land Transaction Tax (Land Tax) if the property you wish to buy is in Wales.

Our fixed fees range from GBP550.00 plus VAT to 0.15% of the purchase price depending on the price of the property you are buying, please see table below. Please note all our fees are based on your matter:

being a standard transaction which proceeds in a timely matter; and

that no unforeseen matters arise, including but not limited to a title defect or the preparation of additional or unforeseen documents; and

where the property being purchased is leasehold, that it involves the assignment of an existing lease and is not the grant of a new lease and that there is not a lease extension.

Disbursements

Disbursements are costs related to your matter that are payable to third parties, such as Land Registry fees. We deal with the payment of the disbursements on your behalf but ask you to pay these to us in advance. The fees involved are usually:

HM Land Registry fees range between GBP20.00 and GBP270.00. These will depend upon whether the property is registered at the Land Registry or not.

Search fees range GBP178.00 and GBP350.00 please note some search fees are subject to VAT in addition

If you are purchasing a Leasehold Property there are likely to be additional disbursements.

Disbursements which we anticipate will apply are set out below, however the amounts vary and those specified below are for indicative purposes only.

Notice of Transfer fee. Generally, between GBP50.00 - GBP250.00;

Notice of Charge fee (if the property is to be mortgaged). Generally, between GBP50.00 - GBP250.00;

Deed of Covenant fee, this fee is set by the management company for the property. Often it is between GBP50.00 - GBP250,000.00;

Certificate of Compliance fee, to be confirmed upon receipt of the lease, generally between GBP50.00 - GBP100.00;

Fees relating to the transfer of membership in any management company, generally in the region of GBP100

The above fees vary from property to property and can on occasion be significantly more. An accurate figure can be given once we have sight of the specific documents. You should also be aware that ground rent and service charge are likely to apply throughout your ownership of the property. We will confirm the ground rent and the anticipated service charge as soon as we receive this information.

Please note: if you are buying a leasehold property that requires an extension of the lease, this can take significantly longer, between 8-12 weeks. In such a situation, additional charges would apply such as the landlords solicitors fees.

Stamp Duty Land Tax

This depends on the purchase price of your property and whether you have any other property interests. You can calculate the amount you need to pay by using the HMRC website or, if the property is located in Wales, by using the Welsh Revenue Authoritys website. Alternatively, we will be happy to calculate this figure for you.

Timescale

How long it will take from your offer being accepted until you can move into your house will depend on a number of factors, such as the length of the conveyancing chain and whether you are having a mortgage. The average process usually takes between 6-8 weeks.

Selling a Freehold or Leasehold Residential Property

Our fees (plus VAT) cover all of the work required to complete the sale of your home, including dealing with discharge of your mainstream mortgage. Our fixed fees range from GBP550.00, 0.15% of the sale price plus VAT and disbursements, please see our fee scale below. Please note all our fees are based on your matter:

being a standard transaction which proceeds in a timely matter; and

that no unforeseen matters arise, including but not limited to a title defect or the preparation of additional or unforeseen documents; and

where the property being sold is leasehold, that it involves the assignment of an existing lease and is not the grant of a new lease and that there is no a lease extension.

Disbursements

Disbursements are costs related to your matter that are payable to third parties, such as Land Registry fees. We handle the payment of the disbursements on your behalf and will ask you to pay these to us in advance.

Disbursements applicable on a sale will be Land Registry Fees of GBP6 plus GBP3 per document required from the Land Registry in addition to your registered title and plan. If you have a mortgage to be discharged there will be a further money transfer fee of GBP36. Please also note that mortgage providers may charge a redemption charge or an administration fee to discharge your mortgage.

If you are selling a Leasehold Residential Property there is likely to be a fee for obtaining a leasehold sale/management pack: generally between GBP100 - GBP500 per pack required.

Leasehold Sales/Management Pack fee: to be confirmed but can range between GBP100.00 - GBP500.00 per pack required.

Legal Fee: GBP400.00

VAT thereon: GBP80

Electronic money transfer fee: GBP36.00

Disbursements

Disbursements are costs related to your matter that are payable to third parties, such as search fees. We deal with payment of the disbursements on your behalf. The disbursements we anticipate will apply are set out below but the list is not exhaustive and other disbursements may apply.

HM Land Registry fee: Generally between GBP6.00 to GBP12.00

HM Land Registry registration fee: Average GBP20

Search Fees or Indemnity Insurance Fees: Approximately GBP300 - please note that some search fees are subject to VAT

Electronic money transfer fee: GBP36
